Agreeing to these terms

These terms of use apply to vsenk.com (the "site"). The site is run by MM Rahman LLC, and VSENK is a brand of MM Rahman LLC ("VSENK", "we", "us").

By using the site, you agree to these terms. If you do not agree, please do not use the site. If you use the site on behalf of a company, you confirm that you can accept these terms for it.

Our privacy policy explains how we handle personal information you share through the site.

Our services have their own agreement

The site describes our services: the Ops Leak Audit, the Autopilot Build and Managed Ops. These descriptions are information, not an offer to provide a service.

We provide services only under a separate written agreement, together with a scope document and an NDA signed before we see any of your data. That agreement sets the price, the scope, the access we get and the terms that apply. If it conflicts with these terms, the agreement wins for anything about the services.

Sending the form on our booking page is a request for a call. It does not create a contract or commit you or us to anything.

Prices, plans and service descriptions on the site can change. The price that applies to you is the one in your signed agreement.

Calculators, estimates and sample data

The site includes tools and examples to help you think about your operations:

• the ops leak calculator;
• the package builder on our pricing page;
• product screens such as reports, dashboards, queues, logs and consoles, and the figures in them.

Results from the calculator and the package builder are estimates. They depend on the numbers you enter and on general assumptions, and the default values are examples. They are not quotes, offers or promises of savings or results.

Product screens and the data in them are samples for illustration. They do not show a real client's data or a promised outcome. Your results depend on your business, your data and your systems.

Statistics from other organizations are shown with their source. We do not guarantee them.

No professional advice

The site gives general information about ecommerce operations. It is not legal, tax, accounting or financial advice. Examples about settlements, fees, reimbursements, inventory or bookkeeping may not fit your situation. Amazon and other platforms also change their rules often. Check the platform's current policies, and talk to a qualified professional before you make decisions that depend on them.

Acceptable use

Use the site lawfully and in good faith. Do not:

• try to break, overload or get around the site's security, for example by probing for weaknesses or sending malware or spam;
• copy the site in bulk with bots or other automated tools, other than search engines and crawlers that follow our robots.txt file;
• send false information through the booking form, or pretend to be someone else;
• send us other people's personal information unless you have the right to share it;
• use the site to harass anyone or to break anyone's rights.

We may block access to the site for anyone who breaks these rules.

Our content

The site and its content, including the text, graphics, illustrations, page designs, code, calculators and the VSENK name and logo, belong to MM Rahman LLC or the people who license them to us. They are protected by copyright, trademark and other laws.

You may view and print pages, and share links to them, for example sending a package link to your team. You may not copy, change, sell or republish our content without our written permission.

If you send us ideas or feedback about the site or our services, we may use them without any obligation to you.

Other companies' trademarks

Amazon, Seller Central, Amazon Ads, Shopify, Walmart, eBay, Etsy, QuickBooks, Xero, ShipStation, Slack and the other product and company names on the site are trademarks of their owners. We use them only to describe the systems we connect to. VSENK is not affiliated with, sponsored by or endorsed by any of these companies.

Links to other sites

The site links to other websites, such as the sources we cite and platform help pages. We do not control those sites and are not responsible for their content, policies or practices. Their own terms apply when you use them.

Disclaimers

We work to keep the site accurate and available, but we provide it "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties about the site, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not promise that the site will always be available, free of errors or free of harmful code, or that its information is complete or current. This section does not change any warranty in a signed services agreement.

Limitation of liability

To the fullest extent the law allows, MM Rahman LLC, VSENK and their owners, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, that arise from your use of the site or your reliance on its content. This applies even if we were told such damages were possible.

Our total liability for any claim about the site is limited to US $100.

Some places do not allow these limits, so some of them may not apply to you. This section covers the site only. Liability for our services is set by your signed services agreement.

Indemnity

If your misuse of the site, or your breach of these terms, leads to a claim against us, you agree to defend MM Rahman LLC, VSENK and their owners, employees and contractors against it, and to cover the resulting losses and costs, including reasonable legal fees.

Governing law and venue

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute about the site or these terms will be heard only in the state or federal courts located in Florida, and you and we agree to their jurisdiction.

If you are a consumer, this section does not take away any rights you have under the mandatory laws of the place where you live. Disputes about our services follow the terms of your signed services agreement.

Changes to these terms

We may change these terms. When we do, we will post the new version on this page and change the "Last updated" date at the top. Changes apply from that date. If you keep using the site after a change, you accept the new terms.

General

If a court finds any part of these terms unenforceable, the rest still applies. If we do not enforce a term right away, we can still enforce it later. These terms and our privacy policy are the whole agreement between you and us about the site.
